    Scott Bratton successfully argued a case in front of the 6th Circuit! The issue was whether there are circumstances where BIA has jurisdiction to hear appeals of MTRs after a person was deported. The regulations indicate against this, but the court agreed with our Firm's stance that at least under the facts of our case that the BIA does have jurisdiction. This is big win not only for this particular case, but will have an impact on others. The case decision was published.

    ZEITUNI ONYANGO'S DECISION RELEASED TO BOSTON GLOBE THROUGH THE FREEDOM OF INFORMATION ACT

    The Boston Globe has received a redacted copy of Zeituni Onyango's decision granting her asylum issued in May 2010. The story and decision are on the Boston Globe website. Ms. Onyango is the aunt of President Barack Obama. I have done several interviews based on the release of the decision. As we have stated throughout the process, Ms. Onyango was entitled to asylum. We fought very hard to reopen her prior removal order and to present her case to the Immigration Court.

    In May 2010, Judge Shapiro, a well-respected, experienced Immigration Judge, issued a 29-page decision setting forth in detail the grounds for granting asylum. We raised numerous arguments in support of being granted asylum. The leak of information pertaining to Ms. Onyango's prior asylum filing right before the 2008 Presidential Election played a significant role in the decision. Based on the evidence and legal arguments we made, the Judge agreed that Ms. Onyango faces a risk of persecution if she returns to Kenya due to the leak of information by the United States Government. This was not a favor to the President as has been suggested by the media and others. Ms. Onyango is entitled to asylum under the laws of the United States and was granted asylum. The President had absolutely no involvement in the case. Based on her grant of asylum, Ms. Onyango will be filing for lawful permanent resident status next May. -Scott Bratton
